Information on the warranty of Faber Products

Due to the type of its products, FABER SpA, despite not qualifying as a seller pursuant to Articles 44 et seq., as well as 128 et seq. of the Consumer Code, has organized a network of external Technical Assistance Centres, located throughout the territory national, which offer assistance with home visits to end buyers and which, based on specific agreements with retailers of FABER brand products, carry out the replacement/repair of products also within the scope of the Legal Guarantee of conformity. Consumers will be able to contact the FABER authorized Technical Assistance Centers directly also for lack of conformity as an alternative to the sellers, who, however, are the only subjects bound by the Legal Guarantee of conformity towards consumers pursuant to Art. . 130 of the Consumer Code.


The guarantee attached to FABER products is a Conventional Guarantee of the Manufacturer towards the Consumer pursuant to Article 133 of the Consumer Code, which does not replace, but is in addition to, the Legal Guarantee of conformity of the products for which the sellers are responsible.

 

Warranty Conditions on Faber Products

The following conditions, relating to the Manufacturer's Conventional Warranty, are automatically activated starting from the date of purchase of the product.

 

1. Duration of the Conventional Warranty

With this warranty, FABER SPA guarantees the product against any defects in materials or workmanship for a period of 2 (two) YEARS starting from the date of purchase which appears on the tax receipt or other document valid for tax purposes issued by the seller and showing the name of the reseller, the identification details of the product and the date of purchase.

 

2 . Conditions of validity of the Guarantee

This Warranty will only be valid if:

  1. The Customer, under penalty of forfeiture, must report the defect to the seller within 2 (two) months from the date of its discovery;
  2. the defective product is presented to the seller, the repair technician or the Technical Assistance Center together with this warranty certificate and the tax receipt or other document valid for tax purposes issued by the seller and containing the name of the reseller, the identification details of the product and the date of purchase. 

FABER SpA reserves the right to refuse interventions under warranty in the absence of the aforementioned documents or in the event that the information contained therein is incomplete or illegible

This warranty will become void if the model or serial number shown on the product have been modified, cancelled, removed or otherwise made illegible

 

3. Contents of the Warranty

During the validity period of this Warranty, in the event that defects in materials or manufacturing are ascertained and recognized, FABER SpA will repair or, at its discretion, replace the defective product or its components free of charge under the terms and conditions below indicated, provided that the conditions referred to in point 2 exist.
The replacement of the product may only take place in the event that this remedy is not objectively impossible or excessively onerous compared to the repair. For the purposes of the operation of this Conventional Guarantee, the replacement of the product must be considered excessively onerous if it imposes unreasonable expenses compared to the repair, taking into account the value that the good would have if there was no lack of conformity, the extent of the lack of conformity and the the possibility that the alternative remedy can be used without significant inconvenience for the Consumer.

  • In the event of repair or replacement of the defective product, the warranty on the repaired product or new product will continue until the end of the warranty originally provided for the repaired or replaced product.
  • Within 24 (twenty-four) months of use of the hood, starting from the date of purchase, the warranty intervention will be carried out without any charge for call-out rights, labor costs and spare parts.
  • In the event of an intervention not covered by warranty, all intervention costs, reasonable and communicated in advance, will be the sole responsibility of the person requesting the intervention.
  • In any case, in relation to defects appearing in the first 6 (six) months from the date of purchase of the product, no cost will be charged for the verification, even if the non-existence of a lack of conformity at the time of delivery is ascertained.
  • If the intervention is carried out at a Faber Technical Assistance Center and the defective product was brought there by the Customer, the risks relating to transport will be borne by the Customer, while they are borne by the Faber Technical Assistance Center if the transport is carried out at the center is managed by the Assistance Center itself.

 

4. Warranty Limits

The following cases are excluded from this Warranty and therefore you will have to pay the Technical Assistance Center all costs - reasonable and previously indicated - due for the intervention, including the cost of any spare parts replaced:

  1. Periodic maintenance interventions and the repair or replacement of parts subject to normal wear and tear such as, for example, lamps, grease filters, activated carbon filters or cartridges, remote control, ceiling lights, and more generally removable parts, accessories and materials of consumption, provided that it is not a manufacturing defect.
  2. Any intervention and/or cost and/or defect and/or possible damage to people, things or animals, resulting from:
  • Installation or use of the product that does not comply with the technical or safety standards in force in the country in which it is used or with the instructions on the installation and correct use of the product contained in the instruction manual supplied with the product;
  • Failure to comply with the instructions on the correct use and periodic maintenance of the product and/or failure to comply with the safety warnings contained in the instruction manual supplied with the product;
  • Improper use of the product such as, for example, use of the product for purposes other than those intended;
  • Product damage caused by the installer and product malfunction caused by incorrect installation. Dents, scratches or other faults, defects or discrepancies caused by incorrect transport, unpacking or handling of the product. The exclusion does not apply if the damage, flaw, defect, discrepancy or incorrect installation is attributable to FABER SpA personnel or to a Technical Assistance Center authorized by FABER SpA;
  • Defects in the systems or equipment to which the product has been connected;
  • Modifications or adaptations made to the product, without prior written authorization issued by FABER SpA, even if such modifications or adaptations have been carried out, in order to conform the product to national or local technical or safety standards in force in countries other than those for which the product was originally designed and manufactured;
  • Repair interventions by unauthorized personnel or by the Customer himself;
  • Fortuitous and unforeseeable events, such as, for example, lightning, floods, fires, incorrect ventilation or other causes not attributable to FABER SpA

 

5. “Out of Warranty” interventions – Technical Assistance

For "out of warranty" appliances, i.e. products for which the 24 (twenty-four) months of warranty have expired, FABER SpA offers a "technical assistance" service at its Assistance Centres. In this case all costs for the intervention will be the sole responsibility of the Customer.

 

6. Territorial extension of the Guarantee

This Guarantee is valid throughout the European Union.
This Conventional Guarantee does not affect the rights to the Legal Guarantee provided for by the Consumer Code of which the Consumer remains the owner. This is the only valid guarantee. No one is authorized to modify the terms and conditions or to issue any other verbal or written guarantees.
